Divorce is different from legal separation and annulment. Plainly put, it is the process of dissolving the marriage. It is acquiring a declaration from the court that the marriage is at an end.

Divorce Proceedings - Negotiating for the Marriage to End

Divorce law and divorce proceedings differ from each country and state and its duration depends on the ancillary issues involved as well as the case load of the court handling them. It may proceed to trial if both parties cannot come up with a settlement that is amenable to both. So as not to result in a contested hearing, the court pressures both parties to leave out emotional content in negotiations during divorce proceedings. Having lawyers during the deliberations can shorten such proceedings and help resolve issues between the two parties because of the cost of paying for attorney’s fees. Divorce proceedings also need to satisfy residency requirements for the state to have jurisdiction over it.

Petition for Divorce - Initiating a Divorce

Filing an original petition for divorce initiates the divorce process. It is a document that requests the court to grant a divorce with a list of any relief that the filing party or complainant is due. It identifies the names of the couple seeking a divorce as well as their children. Moreover, a petition for divorce contains the reason for the divorce such as irreconcilable differences or incompatibility. The petition is then served onto the other party or its respondent. Said respondent has 30 days to hire a lawyer and respond to the petition. Either party can also request for restraining, temporary or protective orders at this time.

Divorce Filing - Its Ramifications

Since each state differs in divorce laws and proceedings, it also differs in divorce filing requirements. In filing for a petition, the document should state how property and debts are to be divided, child custody and support and other data pertaining to the divorce. It also details spousal maintenance. In some states, the start of a divorce process prohibits either party from disposing of marital properties, changing insurance coverage or modifying any other holdings. Due to the length of time taken up in finalizing a divorce, temporary hearings may be done to resolve issues on residence of either party pending the divorce, protection from domestic violence and injunctions against financial improprieties.
